RESTRICTIONS ON USE OF SOFTWARE AND SYSTEMS

  • All software, information and data made available by VTC Taxi remain the property of VTC Taxi and are considered confidential information.
  • Use is only permitted for the intended purpose; copying or distribution to third parties is prohibited.
  • We do not guarantee that the use of the software will be error-free or uninterrupted, nor that the information will always be completely accurate.

USER WARRANTIES

  • You warrant that you are authorised to enter into an agreement and use our services.
  • You are financially responsible for all use of our services with your account, including by family members, colleagues or third parties to whom you grant access.
  • All information provided must be accurate and up to date.
  • You indemnify VTC Taxi against any damage resulting from incorrect or misleading information.

TERMS AND CONDITIONS FOR USE OF THE

  • Registration or telephone booking is required.
  • You are responsible for your account and login details.
  • You are responsible for all bookings made with your account.
  • Bookings may only be made for journeys you intend to undertake; misuse may result in exclusion.
  • Do not use the service for unlawful purposes, including viruses, hacking attempts or unauthorised access.
  • We may amend these terms and conditions in the event of changes to our services. You will be notified of any such changes.
  • You may provide a rating after the journey; inappropriate ratings will be removed and the account may be suspended.

CANCELLATION AND NO-SHOW/NO-FARE CONDITIONS

  • Cancellation is free of charge up to 2 hours before the agreed pick-up time.
  • If you cancel later, part of the fare may be charged.
  • No-show is defined as follows:
    – Failure to be present at the agreed time + 7 minutes
    – Failure of the customer to be present 7 minutes after the car’s arrival
  • In the event of a no-show, 10% of the fare will be charged, with a minimum of €5 for digitally booked journeys.
  • For invoiced journeys, 100% of the fare will be charged in the event of a no-show.
  • A no-show or ‘no fare’ can be avoided by contacting the driver or dispatch centre in good time to report that you will be more than 7 minutes late. Please note that waiting time charges will apply from that point onwards.
  • Repeated no-shows may result in restriction or complete exclusion from our services.

QUOTATIONS, RATES AND WAITING TIMES

  • Fares are communicated as estimated or fixed rates.
  • Estimated fares may vary due to waiting time, route changes, traffic conditions, or customer requests.
  • Fixed rates apply only to the agreed route without additional waiting times or stops. Additional costs may be charged for:
    – Late arrival (waiting time from 7 minutes)
    – Stopovers (waiting time immediately from the moment of stopping)
    – Airport transfers for scheduled flights: 45 minutes waiting time included after landing, then additional waiting time
    – Private jet airports (e.g. Wevelgem Airport): no waiting time included; waiting time is charged immediately
  • Additional costs such as tolls, parking fees, extra stops and necessary cleaning are at the customer’s expense.

PAYMENT AND INVOICING

  • Payment can be made via:
    1. In advance by invoice: payment before the journey; if not paid, payment must be made in the vehicle.
    2. In the vehicle: cash, via available payment methods or with taxi vouchers from the City of Kortrijk.
    3. Afterwards by invoice: only for known customers who respect the 14-day payment term.

  • An administrative fee per invoice applies to invoice payments.

  • Refunds are only possible in accordance with the cancellation policy.

LUGGAGE

  • Travellers must pack their luggage properly.
  • The driver may refuse luggage that is dangerous, prohibited or disruptive, such as weapons, explosives, gases, highly flammable substances, strong odours, drugs or ammunition.
  • VTC Taxi takes reasonable care to prevent loss or damage.
  • VTC Taxi is not responsible for damage, loss or theft of personal belongings.

DRIVER'S RIGHTS AND SAFETY

  • Drivers may refuse transport to remote/unsafe destinations if identity cannot be established (police assistance if necessary).
  • Drivers may request advances for long journeys.
  • Drivers may refuse customers who disturb public order, pose a danger, offend public decency or do not respect
  • Drivers choose the fastest route (not necessarily the shortest) unless the customer requests otherwise.

COMPLAINTS PROCEDURE

  • For complaints about completed journeys, please email info@vtctaxi.be.
  • During a journey or prior to a journey, you can contact us by telephone on +32(0)56/370102.
  • We aim to handle complaints within a reasonable time frame and provide feedback.

CUSTOMER BEHAVIOUR

  • It is forbidden to eat, drink or smoke in the vehicle.
  • Aggressive, intimidating or inappropriate behaviour towards the driver or other passengers will not be tolerated and may result in immediate termination of the journey, without refund.
  • Child seats are not legally required in taxis and therefore cannot be demanded by customers. Parents or guardians are responsible for the safe transport of children in accordance with the legal exceptions to taxi transport.

DELAYS AND WAITING TIMES BY VTC TAXI

  • VTC Taxi strives for punctuality, but cannot guarantee that the journey will always take place exactly on time.
  • We are not liable for delays caused by traffic, traffic jams, road works, weather conditions, technical malfunctions or other external factors.
  • VTC Taxi cannot be held liable under any circumstances for missed connections (e.g. flights or trains) as a result of such circumstances.

INTELLECTUAL PROPERTY

  • All content on the website, app, communications and the VTC Taxi brand (including logo, trade name, texts and images) are protected by intellectual property rights.
  • It is not permitted to use, copy or distribute these without prior written permission from VTC Taxi.

FORCE MAJEURE AND LIABILITY

  • VTC Taxi is not liable for shortcomings due to force majeure.
  • In the event of force majeure, the agreement may be dissolved without entitlement to compensation.
  • If there is no force majeure, VTC Taxi is limited to compensation in the form of a voucher worth up to the fare, to be spent in the app.

COMMUNICATION

  • Communication via telephone, email, app or website is legally valid.
  • Telephone calls are recorded and may be used in the event of disputes or for quality control purposes.

GENERAL

  • Invalid or unenforceable provisions shall not affect the validity of the remaining provisions.
  • If part of a provision can be removed so that the rest remains valid, this shall be applied.

APPLICATION FOR SELF-EMPLOYED DRIVERS

  • When journeys are carried out by independent drivers or subcontractors, the same General Terms and Conditions apply to the customer.
  • Customers cannot invoke differences in legal status: all obligations, liabilities and payment terms remain unchanged.

APPLICABLE LAW AND COMPETENT COURT

  • These terms and conditions are governed by Belgian law.
  • Disputes fall under the exclusive jurisdiction of the court of Kortrijk.
